Mental
Retardation

427
Must use AAMR, 1977
- Must be determined to be in place by 18th
birth date
- IQ 69 is cap for clearly defining mental
retardation
- IQ span 70-75 may be eligible as a person
with mental retardation if; a significant impairment to adaptive
functioning exists that is directly related to the issues of mental
retardation (see 6. in right column)
- This adaptive impairment cannot be primarily
related to any of the following:
- mental/ emotional disorders
- sensory impairments
- substance abuse
- personality disorder
- learning disability
- ADHD

Definition
State of Oregon develops the guidelines for
interpretation.
- Must be determined to be in place by 22nd
birth date
- IQ scores are not used in verifying the
presence of a non-mental retardation developmental disability
- Must have either an official medial or
clinical diagnosis of the disability and a significant impairment to
adaptive functioning ht is directly related to the specific
disability
- This adaptive impairment cannot be primarily
related to any of the following:
- mental/ emotional disorders
- sensory impairments
- substance abuse
- personality disorder
- learning disability
- ADHD
- In the State of Oregon, the developmental
disability must have its genesis in the brain
- The support needs of the person must be
"similar to that required by individuals with mental retardation
(OAR309-041-0405(17)) i.e.: self care, receptive language, expressive
language, mobility, self-direction, and a need for multiple-specialized
supports indefinitely

Most frequent other developmental disabilities (above right
column) seen for eligibility are:
- Cerebral palsy
- tourettes
- fragile X syndrome
- Prader Willier
- fetal neurological disorders (alcohol, lead,
drugs, disease)
- epilepsy
- Klinefelter
- TBI( traumatic brain injury)
- Pervasive Developmental Disorders
