The following information sets out general recording requirements. This information is not all-inclusive or comprehensive. Questions should be directed to Deeds and Records staff for further clarification.
First Page Recording Requirements
Following is a list of requirements that must appear on the first page of the document being recorded. The first three items listed apply to every document presented for recording. Items 4 and 5 apply to specific document types.
- Document Title(s): ORS 205.236 The title describes the type of transaction being recorded. A document may contain multiple titles; however, each title must be clearly labeled in sufficient detail to enable the recording clerk to index the document in the appropriate record. The recording transaction fee for each distinguishable title is $5.00.
- Names of the parties involved in the transaction: ORS 205.234(1)(b) For example, Grantor and Grantee. Alternatives to Grantor and Grantee may be Seller and Buyer, Borrower and Lender, Mortgagor and Mortgagee, Debtor and Creditor, and others.
- The words "After Recording Return To" followed by a name and address ORS 205.234(1)(c). This is the name and address of the party who is to receive the document after recording.
- Consideration: ORS 93.030 True and actual consideration paid for a property, or the amount of imposed monetary obligation. This requirement applies to all documents which convey or contract to convey fee title to real property, and to all liens.
- The words "Send Tax Statement To" followed by a name and address ORS 93.260 This requirement applies to all documents which convey or contract to convey fee title to real property.
Additional Recording Requirements:
- All Signatures and Notaries must be original. Photocopies cannot be recorded. Notary seals may not cover any text on the document. Notary seals must be legible. A notary seal that is blurred or faint is not acceptable for recording. OAR 160-100-000
- Legal Description of Real Property. Acceptable examples include: lot, block and subdivision name; partition plat recording and parcel numbers; and boundaries described by metes and bounds. Alternatively, you may refer to the book and page or document number of any document recorded in Lane County where the description may be found. Tax lot numbers are not acceptable. ORS 93.600.
- Marking of any text on an a document with a highlighter is not acceptable. Highlighting adversely effects legibility and the reproduction quality of the permanent record.
- Document Types Which Require a Reference Number. A reference number is required when the document to be recorded links to another transaction affecting the same property. Examples include: Satisfactions, Assignments, (most) Affidavits, Amendments, Terminations and Subordinations.
Legibility Requirements: (ORS 205.232)
Recording a document makes it a public record and puts the public on notice. Since the public and courts may use the recorded documents to establish the validity of claims, all pages must be readable. The following three legibility requirements are mandatory:
- Text (typed, written or printed) must be 8 point or larger.
- Paper must be of sufficient quality for recording photographically.
- Paper must be 8 1/2" by 14" or smaller.
Common legibility problems which lead to rejection of documents:
- Text that is light, blurred, contrasting light and dark, heavy and filled in or has typed through lines.
- Dark colored paper
- NCR copy
